Avoiding Jail - Eligibility for the Diversion Program
Hamilton County has alternatives available as part of it’s drug court diversion program. If you qualify for the diversion program --- called intervention in lieu of conviction--- your case will be dismissed if you can complete certain requirements - including a drug treatment program and a period of probation. If your case is dismissed you then have the opportunity to have the record of the arrest for the drug offense expunged.
Criminal Forfeitures and Drug Charges
Under state and federal law, the government can seize any assets or property it believes was obtained with the proceeds from illegal activity. Once a criminal forfeiture is initiated, bank accounts can be frozen, homes and cars seized, and businesses closed. At the law office of Raymond T. Faller, we challenge criminal forfeiture, filing motions to stop the forfeiture with the court on behalf of our client. We are prepared to work with accountants to challenge allegations on the part of government investigators regarding our client's earnings and sources of income.
